AI-generated content carries machine-readable marking
What the source requires
To the extent technically feasible, a covered provider must include a latent disclosure meeting the statute's criteria in any image, video or audio content its GenAI system creates or alters, except by minor modification. Applied from 2026-08-02.
Why this is hard to satisfy
Most practices do not know the requirement exists, and no consumer tool embeds the metadata.
What we do about it
Marking is applied in the generation pipeline, so anything we produce is marked by construction. Note that absence of a marking proves nothing about content we did not generate. EU AI Act Article 50 imposes a parallel marking obligation from the same date: a separate regime, and not the authority this rule quotes.

What this tier means
Same input, same verdict, every time — no model in the loop. This is the only tier where the word “verified” is literally true.
