“Results not typical” does not cure a misleading result claim

What the source requires

The regulator states, on the basis of its own consumer testing, that a “results not typical” style disclaimer is insufficient to cure an otherwise misleading depiction.

Why this is hard to satisfy

The disclaimer is treated across the industry as a safe harbour, so the problem is invisible to the people writing the copy.

What we do about it

The anti-pattern is detected on sight and the claim is surfaced with what would actually be required instead.

What this tier means

Same input, same verdict, every time — no model in the loop. This is the only tier where the word “verified” is literally true.
